1. Acceptance of These Terms
These Terms of Use ("Terms") govern access to and use of PublicPulse.live, related websites, applications, and services (collectively, the "Platform") operated by Public Pulse Inc. ("Public Pulse", "we", "our", or "us"). By creating an account, accessing, or using the Platform, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.
2. About Public Pulse
Public Pulse is an independent civic engagement and public opinion technology platform. It enables eligible users to participate in National Topics, Local Civic Issues, report local issues for review, view aggregated public opinion trends, and participate in private or invitation-only Groups.
Public Pulse does not endorse or support any political party, politician, candidate, government body, Organization, or policy position. Publication of a question, issue, Group question, statistic, report, or result does not constitute endorsement or factual verification by Public Pulse.
3. Eligibility
You must be at least 18 years old and satisfy the residency or geographic eligibility requirements displayed by the Platform. By creating an account, you confirm that the information you provide is accurate and that you have legal capacity to agree to these Terms. Public Pulse may suspend or terminate accounts that do not meet eligibility requirements.
4. User Accounts
You are responsible for maintaining the confidentiality of your credentials, keeping account information accurate, notifying Public Pulse of unauthorized access, and remaining responsible for activity under your account.
5. One Account Per Person
Each individual may maintain only one Public Pulse account. You may not create multiple accounts, share accounts, impersonate another person, or use automated methods to create accounts. A person who registers through a Group invitation is creating a Public Pulse account and must not create a second account for general Platform use.
6. Acceptable Use
- Do not manipulate voting or participation results.
- Do not attempt duplicate participation through multiple accounts.
- Do not use bots, scripts, automated systems, or fraudulent methods to participate.
- Do not interfere with Platform security or attempt unauthorized access.
- Do not scrape, copy, reverse engineer, or commercially exploit Platform data or technology without permission.
- Do not use the Platform for unlawful, fraudulent, abusive, threatening, defamatory, or harmful purposes.
- Do not attempt to identify individual respondents from aggregated or anonymized results.
7. Public Opinion Participation
Participation is voluntary. Results represent the views of participating users and do not guarantee that any government, institution, Organization, or other person will act upon them. Unless expressly stated otherwise, Public Pulse results are not scientific polling, election forecasting, or statistically representative population estimates.
8. Private and Invitation-Only Groups
A. Group Access
Public Pulse may provide private or invitation-only Groups for universities, professors, educational institutions, employers, municipalities, associations, researchers, community organizations, companies, and other participating organizations (each an "Organization"). Access may be provided by invitation link, access code, or another approved method.
B. Group Participants Remain Public Pulse Users
Creating an account through a Group invitation creates a regular Public Pulse account. Subject to eligibility and Platform rules, Group participants may also access National Topics, Local Civic Issues, results, and other Public Pulse features. An Organization does not own, administer, or control a participant's general Public Pulse account.
C. Public Pulse Administers Group Access
Public Pulse may know that an account joined, accessed, or is eligible for a particular Group because that information is necessary to provide Group access, administer the Platform, prevent misuse, and maintain Group integrity. Public Pulse does not disclose account-level Group membership or access information to the Organization except as expressly described in the Privacy Policy, required by law, or authorized by the participant.
D. No Participant List for Organizations
Public Pulse does not provide an Organization with a list identifying which invited individuals created accounts, joined the Group, participated, or failed to participate. Organizations may receive only aggregated or anonymized participation totals and results, subject to Public Pulse privacy safeguards.
E. Individual Responses Are Not Provided to Organizations
Public Pulse does not provide an Organization with information identifying how a particular participant answered a Group question. Membership in a Group also does not entitle the Organization to access a participant's answers or participation history concerning National Topics, Local Civic Issues, or other Groups.
F. Voluntary Participation
Joining a Group does not require a participant to answer every Group question. Public Pulse does not guarantee that Group participation is anonymous from facts independently known to an Organization, but Public Pulse will not disclose participant identities or individual responses through Group reporting. Organizations must not use Public Pulse to improperly pressure participants to reveal how they answered.
G. Privacy Thresholds
Public Pulse may suppress, combine, delay, or withhold Group demographic, geographic, or other segmented results where participation is too small or where a breakdown could reasonably increase the risk of identifying an individual. Public Pulse may establish minimum reporting thresholds and may restrict combinations of demographic or geographic attributes to protect participant privacy.
H. Invitation Codes and Eligibility
Users must not publicly distribute a restricted Group code, use a Group invitation for which they are not eligible, transfer Group access, impersonate an eligible participant, or circumvent access restrictions. Public Pulse may revoke Group access without terminating the user's general Public Pulse account.
I. Organization-Supplied Questions
Organizations may propose questions for their Groups. Public Pulse may review, edit, clarify, reject, suspend, or remove Group questions where reasonably necessary for neutrality, clarity, privacy, safety, legality, Platform integrity, or compliance with Public Pulse policies. Payment or sponsorship does not remove Public Pulse's right to enforce Platform standards.
J. Group Expiry or Removal
A participant's removal from a Group, expiration of a Group, or termination of an Organization's arrangement with Public Pulse does not automatically terminate the participant's general Public Pulse account.
9. Organization Conduct and Group Integrity
Where an Organization uses Public Pulse Groups, the Organization must not use the Platform to unlawfully discriminate, harass, retaliate against, or improperly monitor participants; attempt to identify anonymous respondents; reverse-engineer individual answers from aggregated results; misrepresent Public Pulse results; or submit Personal Information to Public Pulse without appropriate authority.
Additional commercial, confidentiality, payment, licensing, data-processing, privacy, and service terms may be governed by a separate agreement between Public Pulse and the Organization. These Terms do not replace such an agreement.
10. Local Issue Submissions
Users may submit local issues for consideration. Submissions may be reviewed, edited, summarized, generalized, rewritten, approved, rejected, or removed. Public Pulse retains editorial discretion and does not guarantee publication.
Users must not submit defamatory, knowingly false or misleading, confidential, threatening, abusive, unlawful, or unnecessarily identifying information, including Personal Information about others without lawful authority.
11. Editorial Independence
Public Pulse retains editorial and Platform-integrity discretion over content made available through the Platform. We may edit question wording, modify issue wording, change categories, remove content, refuse publication, update participation materials, and apply neutrality, clarity, privacy, safety, and legal standards. Organization sponsorship or payment does not constitute endorsement by Public Pulse.
12. Intellectual Property
Public Pulse's logos, trademarks, branding, software, designs, graphics, text, databases, public opinion reports, analytics, visualizations, methodologies, and other Platform materials are owned by or licensed to Public Pulse and are protected by applicable intellectual property laws.
Except as permitted by Public Pulse or a separate Organization agreement, users may not reproduce, distribute, modify, sell, scrape, or exploit Platform content.
13. Public Opinion and Aggregated Data
Public Pulse owns or controls the aggregated datasets, analytics, reports, visualizations, statistical models, and research generated through operation of the Platform, subject to applicable law and any separate written agreement with an Organization.
By participating, users acknowledge that Public Pulse may use anonymized and aggregated participation data for research, statistical reporting, academic collaboration, civic engagement initiatives, commercial analytics, and Platform improvement. Public Pulse does not sell Personal Information.
Use of data derived from a private Group may be further limited by a separate written agreement with the applicable Organization.
14. Group Reports and Organization Use
Group reports may be provided to an Organization under a separate commercial or pilot arrangement. Unless otherwise agreed in writing, Group results are informational and reflect only participating users.
Organizations must not present results in a misleading manner or claim that Group results represent a broader population where the methodology does not support that claim.
Rights to reproduce, publish, distribute, commercially use, or restrict use of a customized Group report or Group-derived data may be addressed in the applicable Organization agreement.
15. Communications
Public Pulse may send communications necessary to create, operate, secure, and administer an account or Group, including account verification, password resets, security notices, Group-access notices, and other service-related communications.
Where permitted by law and with any consent required by applicable law, Public Pulse may also send optional communications regarding new Public Pulse topics, results, features, research, Platform updates, or other engagement opportunities. Users may unsubscribe from optional communications without terminating their Public Pulse account or Group access.
16. Third-Party Services
The Platform may integrate with authentication, mapping, analytics, cloud hosting, communications, payment, and other third-party providers. Use of those services may also be governed by their own terms and privacy policies. Public Pulse is not responsible for third-party services to the extent permitted by law.
17. Accuracy and Methodology
Public Pulse strives for clear and accurate presentation but does not guarantee that all content is complete, current, error-free, or suitable for a particular purpose. Participation is voluntary and self-selected unless expressly stated otherwise. Results should not be interpreted as official polling, election forecasting, legal advice, professional advice, or representative population statistics.
18. Disclaimer of Warranties
The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Public Pulse disclaims warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted access, continuous availability, or error-free operation.
19. Limitation of Liability
To the fullest extent permitted by applicable law, Public Pulse and its directors, officers, employees, contractors, affiliates, and agents will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to use of the Platform. Nothing in these Terms excludes liability that cannot lawfully be excluded.
20. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Public Pulse and its officers, directors, employees, contractors, affiliates, and agents from claims, damages, losses, liabilities, costs, or expenses arising from your unlawful use of the Platform, material breach of these Terms, violation of applicable law, or information you submit to the Platform.
21. Suspension, Group Removal, and Termination
Public Pulse may suspend, restrict, or terminate an account or Group access where we reasonably believe there has been a violation of these Terms, manipulation of participation, multiple accounts, fraudulent or unlawful activity, unauthorized Group access, interference with Platform integrity, or other material misuse.
Public Pulse may remove a user from a Group without terminating the user's general account. Termination does not affect rights or obligations that accrued before termination.
22. Changes to the Platform
We may modify, suspend, discontinue, or improve aspects of the Platform, including Groups, at any time. We are not obligated to maintain any particular feature or service, subject to any separate contractual commitments made to an Organization.
23. Changes to These Terms
We may update these Terms from time to time. Updated versions will be posted with a revised "Last Updated" date. Where required by law, additional notice will be provided for material changes. Continued use after changes become effective constitutes acceptance to the extent permitted by law.
24. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Subject to applicable consumer protection or other mandatory laws, disputes arising from these Terms or the Platform will be subject to the jurisdiction of the courts located in Ontario, Canada.
