The terms governing your access to and use of PublicPulse.live and related services.

1. Acceptance of These Terms

Welcome to Public Pulse.

These Terms of Use ("Terms") govern your access to and use of PublicPulse.live, related websites, mobile applications (if any), and services (collectively, the "Platform") operated by Public Pulse Inc. ("Public Pulse", "we", "our", or "us").

By creating an account, accessing, or using the Platform, you agree to be legally bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not use the Platform.

2. About Public Pulse

Public Pulse is an independent civic engagement and public opinion platform that enables users to:

  • Participate in public opinion questions;
  • Participate in verified local civic issues;
  • Report local issues for review;
  • View public opinion trends and participation insights.

Public Pulse is a technology platform and does not endorse or support any political party, politician, candidate, government body, organization, or policy position.

The publication of questions, issues, statistics, or public opinion data does not constitute endorsement or factual verification by Public Pulse.

3. Eligibility

You must be 18 years of age or older to use the Platform.

By creating an account, you confirm that:

  • you are at least 18 years old;
  • the information you provide is accurate;
  • you have the legal capacity to enter into these Terms.

We reserve the right to suspend or terminate accounts that do not meet these requirements.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials.

You agree to:

  • keep your account information accurate and up to date;
  • notify us promptly of any unauthorized access to your account;
  • remain responsible for all activity occurring under your account.

5. One Account Per Person

Each individual may maintain only one Public Pulse account.

You may not:

  • create multiple accounts;
  • share accounts with others;
  • impersonate another individual;
  • use automated methods to create accounts.

Accounts found to violate this policy may be suspended or permanently removed.

6. Acceptable Use

You agree to use the Platform only for lawful purposes.

You must not:

  • manipulate voting results;
  • attempt duplicate participation through multiple accounts;
  • use bots, scripts, or automated systems;
  • interfere with Platform security;
  • attempt unauthorized access;
  • scrape or copy Platform data without permission;
  • reverse engineer the Platform;
  • use the Platform for unlawful or fraudulent purposes.

Public Pulse may investigate suspected misuse and take appropriate action.

7. Public Opinion Participation

Participation in Public Pulse is voluntary.

Users acknowledge that:

  • public opinion questions reflect current topics selected by Public Pulse;
  • participation does not create any contractual, employment, or advisory relationship;
  • results represent the views of participating users only.

Participation does not guarantee that any government, organization, or institution will act upon the results.

8. Local Issue Submissions

Users may submit local issues for consideration.

By submitting information, you acknowledge that:

  • submissions may be reviewed, edited, summarized, rewritten, approved, rejected, or removed;
  • Public Pulse has complete editorial discretion regarding publication;
  • submission does not guarantee publication.

Users must not submit:

  • defamatory material;
  • false or misleading information;
  • confidential information;
  • personal information about other individuals without lawful authority;
  • abusive, threatening, or unlawful content.

Public Pulse may remove any submission at its sole discretion.

9. Editorial Independence

Public Pulse maintains complete editorial independence over all content published on the Platform.

We reserve the right to:

  • edit questions;
  • modify issue wording;
  • change categories;
  • remove content;
  • refuse publication of submissions;
  • update participation materials.

Editorial decisions are made solely by Public Pulse.

10. Intellectual Property

All Platform content, including but not limited to:

  • logos;
  • trademarks;
  • branding;
  • software;
  • designs;
  • graphics;
  • text;
  • databases;
  • public opinion reports;
  • analytics;
  • visualizations;
  • methodologies;

are owned by or licensed to Public Pulse and are protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, sell, or exploit any Platform content without our prior written permission.

11. Public Opinion Data

Public Pulse owns all aggregated datasets, analytics, reports, visualizations, statistical models, and research generated through operation of the Platform.

By participating, you acknowledge that Public Pulse may use anonymized and aggregated participation data for:

  • research;
  • statistical reporting;
  • academic collaboration;
  • civic engagement initiatives;
  • commercial analytics;
  • platform improvement.

Public Pulse does not sell personal information.

12. Third-Party Services

The Platform may integrate with third-party services, including authentication providers, mapping providers, analytics providers, and cloud hosting providers.

Your use of those services may also be governed by their own terms and privacy policies.

Public Pulse is not responsible for third-party services.

13. Accuracy of Information

Public Pulse strives to present accurate information but does not guarantee that all content is complete, current, or error-free.

Participation results are based on voluntary user participation and should not be interpreted as official polling, election forecasting, legal advice, professional advice, or representative population statistics.

14. Disclaimer

The Platform is provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, Public Pulse disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee uninterrupted access, continuous availability, or error-free operation.

15. Limitation of Liability

To the fullest extent permitted by law, Public Pulse, its directors, officers, employees, contractors, affiliates, and partners shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the Platform.

Your use of the Platform is entirely at your own risk.

16. Indemnification

You agree to indemnify and hold harmless Public Pulse and its officers, directors, employees, contractors, affiliates, and agents from any claims, damages, losses, liabilities, costs, or expenses arising from:

  • your use of the Platform;
  • your breach of these Terms;
  • your violation of applicable law;
  • information you submit to the Platform.

17. Suspension and Termination

Public Pulse may suspend, restrict, or terminate access to the Platform without prior notice where we reasonably believe a user has:

  • violated these Terms;
  • manipulated participation;
  • created multiple accounts;
  • engaged in fraudulent or unlawful activity;
  • interfered with Platform integrity.

Termination does not affect rights or obligations that accrued before termination.

18. Changes to the Platform

We may modify, suspend, discontinue, or improve any aspect of the Platform at any time without prior notice.

We are not obligated to maintain any particular feature or service.

19. Changes to These Terms

We may update these Terms from time to time.

Updated versions will be posted on this page with a revised "Last Updated" date.

Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.

20. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Any disputes arising from these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.
